Terms of service
The agreement between you and us, and which document wins when two of them disagree.
Who you are contracting with
Your contract is with FastUTV LLC, a California limited liability company doing business as DEFI Motorsports. Ordering from this site, or having work performed at the shop, means you accept these terms.
Which document governs
Dyno testing, tuning and performance services are governed by the Dyno Testing, Tuning & Performance Services Agreement, which you accept before booking or paying. Where that agreement and this page disagree, the agreement governs.
The returns policy, shipping policy, warranty page and emissions disclaimer are part of these terms and are incorporated here.
Prices, and what happens when one is wrong
Every price on this site is rebuilt on our own server from your vehicle and the options you chose before any payment is taken, so the figure you are charged is the figure the page showed you. If the two ever disagree, the checkout stops rather than charging a number you have not seen.
Prices can change. A price shown in a cart you left open for weeks is not a price we are bound to. If the catalogue has changed under an old cart, we will tell you and show you the current figure before anything is charged.
Obvious errors — a price that is plainly wrong rather than merely keen — do not create a contract, and we will contact you rather than silently cancel.
What you are responsible for telling us
A calibration is written against the vehicle you describe. Undeclared modifications — a different injector, a camshaft, a pulley, a controller that has already been tuned by someone else — can make a calibration unsafe for your engine.
You are responsible for declaring what is on the car and for the accuracy of the VIN you give us. If something changes between ordering and flashing, tell us before you flash.
All sales are final
Licences are consumed on application and bind permanently to one engine controller. There are no returns, refunds or exchanges. The full policy, and the reasoning, is on the returns page, and you acknowledge it at checkout before paying.
Our calibration files stay ours
A DEFI calibration is our work. You get the right to run it on the vehicle it was written for. You do not get the right to copy it, resell it, publish it, or flash it onto another vehicle, and the RTD4 is configured so that the file is written to the controller locked.
Everything else on this site — text, photographs, dyno sheets, the vehicle data and the way it is organised — belongs to us and is not yours to republish.
Off-road and competition use
Calibration work is sold for off-road and competition use. A tuned vehicle is not smog-legal in California and will not pass inspection in the tuned state. How the vehicle is used afterwards, and the legal consequences of that use, are yours. The emissions disclaimer sets this out in full.
Limits
To the fullest extent the law allows, we are not liable for indirect or consequential loss — lost time, lost earnings, the cost of a tow, or the value of an event you did not make. Nothing here attempts to exclude liability that cannot lawfully be excluded.
The Services Agreement contains the assumption of risk and release you accepted, in the capitalised form required for it to be conspicuous, and it governs.

These terms are governed by the law of the State of California.
